License: Ashé authors and artists agree to allow their work to be published in a single issue of Ashé (a serial periodical, print and online editions), to be maintained in the issue archives for the duration of such an archive and to be included, if selected, in any ‘best of’ anthologies that may appear in the future. Anthology rights is strictly limited to works that are clearly connected with Ashé and display the Ashé Journal designation on their covers. Ashé will not use submitted work for any other purpose than noted here.
Copyright: The copyright in the Work shall remain the property of the Author/creator.
Compensation: Each author included in the print edition will receive a copy of the issue in which their work appears. No other royalties or author compensation shall be paid.
Permission for copyrighted materials: The Author shall be responsible for obtaining the necessary written permission(s) from the owner(s) for use of all copyrighted materials or material incorporated in the Work, and to furnish copies of said permission(s) to the Publisher at the same time the Work is delivered. The Author is responsible for fees, royalties, and other charges for the use of copyrighted materials.
INDEMNIFICATION BY AUTHOR: The Author hereby warrants to the Publishers and their assigns and licensees that he/she has full power to make this Agreement, that he/she is the sole author of the Work and is the owner of the rights herein granted, that the Work is original to him/her, and has not previously been published in volume form in the territories covered by this Agreement (excepting as noted below), that the Work is in no way whatever a violation or an infringement of any existing copyright or license, that it contains nothing libelous, that all statements contained therein purporting to be facts are true, and that any recipes or formulae or instructions contained therein are not injurious to the user. The Author will indemnify and keep the Publishers indemnified against all actions, suits, proceedings, claims, demands, damages and costs including any legal costs or expenses properly incurred and any compensation costs and disbursements paid by the Publishers on the advice of their legal advisors to compromise or settle any claim) occasioned to the Publishers in consequence of any breach of this warranty or arising out of any claim alleging that the Work constitutes an infringement of copyright or contains libelous or defamatory matter. The Publishers reserve the right to insist that the Author alter the text of the Work in such a way as may appear to them appropriate for the purpose of removing any passage which on the advice of the Publishers’ legal advisors may be considered objectionable or likely to be actionable by law, but any such alteration or removal shall be without prejudice to and shall not affect the Authors’ liability under his/her warranty and indemnity herein contained.
Entire Agreement: This Agreement contains the entire agreement between the Author and Publisher with respect to the subject matter hereof and shall supersede all prior understandings, agreements or arrangements, oral or written, between the parties in this Agreement.
Survivability of Agreement: In the event one or more of the provisions of this Agreement is deemed to be invalid, illegal, or unenforceable in any respect under applicable law, the validity, legality, and enforceability of the remaining provisions hereof shall not in any way be impaired thereby. This Agreement shall be binding on the Author and Publisher, and upon their respective heirs, administrators, successors, and assigns, for as long as a registered copyright to the Work remains in force, unless terminated by written agreement of all parties, or by specific provision elsewhere in this Agreement.
Governing Law: This Agreement shall be governed by and construed in accordance with the Laws of the State of Maine, United States of America.
By submitting work for consideration, contributors acknowledge their acceptance to this agreement. A positive affirmation of acknowledgement of this agreement is required before publication.
